Voluntad y conocimiento en la teoría del acto administrativo de Zanobini

RESUMEN:
Zanobini, al definir el acto administrativo, no se conformó con la declaración de voluntad en qué consistía el acto jurídico según la tradicional doctrina iusprivatista, sino que se propuso hacer patente, mediante la declaración, el contenido del acto. Tomó para ello las principales funciones del espíritu —voluntad y conocimiento—, derivó de ellas deseo y juicio y definió el acto administrativo como «cualquier declaración de voluntad, deseo, conocimiento, juicio…». En este artículo se critica porque, además de no conseguir su propósito, la amplia aceptación de su definición crea una confusión doctrinal perniciosa para la claridad necesaria de la teoría del acto administrativo.

"Will and knowledge in Zanobini’s theory of administrative acts"
ABSTRACT:
Zanobini, in defining the administrative act, did not simply rely on the dec-laration of will that constituted the legal act according to traditional private law doctrine. Instead, he sought to make the act’s content explicit through the declaration itself. To this end, he considered the principal functions of the mind—will and knowledge—derived desire and judgment from them and defined the administrative act as “any declaration of will, desire, knowledge, judgment…”. This article criticizes this definition because, in addition to failing to achieve its purpose, its widespread acceptance creates a pernicious doctrinal confusion that undermines the necessary clarity of the theory of the administrative act.
