RESUMEN:

La condición de militares de los miembros de la Guardia Civil y la naturaleza militar de la Institución ha quedado claramente plasmada en la normativa de aplicación. No sólo por el peso de la tradición histórica, sino por el propio desarrollo de los artículos 8 y 104 de la CE, a los miembros del Benemérito Instituto se les ha venido acreditando dicha condición de militar, independientemente de que sus funciones sean encuadradas dentro de las propias de los Fuerzas o Cuerpos de Seguridad del Estado o dentro de las misiones inherentes a las FAS. El panorama normativo posterior, tanto en el ámbito de la Guardia Civil como de las Fuerzas Armadas, ha dejado más claro, si cabe, la naturaleza militar de sus miembros y de la Institución de la que forman parte.

"Nature and military character of the Civil Guard: commentary
on the ruling of the third chamber of the Supreme Court of February 13, 2012"

ABSTRACT:

The military condition of the members of the Civil Guard and the military nature of the Institution it has been shaped clearly in the legal system. Not only by the weight of the historical tradition, but by the own development of articles 8 and 104 of the Spanish Constitution, the members of this Institute have had accredited this military condition, independently of which their functions are fitted within own of the Security Forces or within the inherent missions to the Armed Forces. The later normative scenario, as much in the sphere of the Civil Guard like of the Armed Forces, has left more sure if it fits, the military nature of its members and the Institution of which they comprise.
