RESUMEN:
El ensayo aborda, de inicio, el tránsito que, en breve espacio de tiempo, tiene lugar desde una situación jurídica en la cual ni se planteaba el despido por razones «empresariales» en la Administración a otro en el cual el desmesurado crecimiento del sector público, unido a la crisis, ha situado el reajuste de sus plantillas en tema de permanente actualidad. El núcleo de la reflexión queda situado en desentrañar el «enigma» de cuanto ha de entenderse por insuficiencia presupuestaria sobrevenida y persistente, como traducción de las causas económicas comunes cuando afectan a la Administración en sentido estricto, vinculando su funcionalidad a las medidas preventivas o coercitivas reguladas en la normativa de estabilidad presupuestaria y sostenibilidad financiera; al tiempo, efectúa un sucinto repaso de las otras causas (técnicas, organizativas ¿y de producción?) que, en principio, están llamadas a jugar un papel secundario o complementario y no presentan grandes peculiaridades en su aplicación respecto al que desarrollan en el sector privado. Concluye con una sucinta reflexión sobre el margen de que disponen los Tribunales para valorar el carácter proporcional de los despidos que bajo tal motivación se llevan a cabo.

TITLE:
"The particularity of proper reasons for collective redundancies in the public sector"
ABSTRACT:
This paper analyses, initially, the change that, in a short period, takes place from a legal situation in which nobody raised the possibility of collective redundancies in the Administration, to another in which the excessive growth of the public sector, linked to the crisis, have placed the readjustment of the staff of public employees in a permanent topic today. The key point is situated in unraveling the «enigma» about the concept and the meaning of supervened and persistent budgetary shortages, as a translation of the common economic causes when they affect the Administration in the strict sense, connecting their functionality with the measures (preventive or coercive) regulated by budgetary stability and financial sustainability laws. At the same time, the essay examines the other causes (technical, organizational and ¿productive?) that, in theory, are destined to play a secondary or complementary function and, whose application have not novelty with regard to their role in the private sector. It concludes with a brief consideration about the margin available to the courts when assessing the proportionality of the redundancies.
